1. Introduction
Welcome to Marka Gold, a Customer Relationship Management (CRM) platform designed for jewelers. These Terms of Service ("Terms") govern your access to and use of our mobile application, TV application and related services (the "Service"). By using Marka Gold, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our Service.
2. Service Description
Marka Gold is a software platform that enables jewelers to manage customer relationships, create product certificates, track repairs, and manage currency rates. Our platform is open to all jewelers, who bear full responsibility for the data they enter, including product information, certifications, and any other content.
Marka Gold solely functions as a service provider and does not assume any responsibility for the accuracy, completeness, or validity of the data entered by users. Any claims, disputes, or issues arising from the use of data within the platform are the sole responsibility of the respective jeweler.
3. User Accounts
- To use Marka Gold, you must create an account and provide the necessary registration details.
- Each user is responsible for maintaining the confidentiality of their account credentials.
- If you suspect unauthorized access to your account, you must notify us immediately.
- Marka Gold reserves the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use Policy
By using Marka Gold, you agree not to:
- Engage in any fraudulent, unlawful, or deceptive activities.
- Distribute spam, phishing attempts, or unauthorized advertisements (violation of KVKK and Law No. 6563 on E-Commerce).
- Use the service to collect or process sensitive personal data without explicit consent.
- Attempt to hack, disrupt, or interfere with the functionality of Marka Gold.
- Reverse-engineer, copy, or attempt to replicate any part of the platform.
You are also solely responsible for the obligations under Law No. 5549 (MASAK) for gold transactions of TRY 185,000 and above, including national ID identification, recording, suspicious transaction reporting and 8-year retention.
Violations of this policy may result in immediate account suspension or termination.
5. Information We Collect
Marka Gold collects and processes certain types of information from users and their customers, including:

- Full Name
- Email Address
- Phone Number (optional)
- Business Name (if applicable)
- Password (stored as a one-way bcrypt hash)
- Location (Country/City)
- Company Logo or Business Identity (if uploaded by the user)
5.2 Device and Usage Information
- IP Address
- Device Type (Mobile, Desktop, Tablet, etc.)
- Operating System and Version
- Browser Type and Version
- Login Time and Duration
- Pages Visited on the Platform
- Crash Reports and Error Logs
5.3 Customer Data Processed by Users
- Customer Name
- Customer Contact Details (Phone, Email, Address)
- Product Purchase Details (Date, Item, Serial Numbers, etc.)
- Product Certificates and Warranty Information
- Service and Repair History
Marka Gold does not access or use this customer data for any purpose beyond providing the CRM service. The responsibility of managing, updating, and deleting customer data lies entirely with the respective jeweler. Users are responsible for obtaining customer consent where required by law before collecting and processing personal data.
6. Limitation of Liability
- Marka Gold is provided "as is" and "as available," with no warranties regarding accuracy, reliability, or fitness for a particular purpose.
- Marka Gold shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the Service.
- Users assume full responsibility for the accuracy and security of the data they enter.
- Marka Gold shall not be held responsible for any interruptions, data losses, or failures beyond its control.
- To the extent permitted by law, Marka Gold's total liability is limited to the annual subscription fee for the year in which the incident occurred.
7. Termination of Accounts
- Marka Gold reserves the right to suspend or terminate access to the platform if users violate these Terms.
- Users may terminate their account at any time, but no refunds will be provided for paid services (if applicable).
- Users assume full responsibility for the accuracy and security of the data they enter.
- Upon termination, users are responsible for backing up any data, as Marka Gold may delete all associated records.
8. Force Majeure
Marka Gold shall not be liable for any failure or delay in service performance due to causes beyond its control, including but not limited to:
- Natural disasters
- Cyberattacks
- Government regulations
- Power failures or internet outages
- Third-party cloud provider outages
Such events may impact service availability without prior notice.
9. Governing Language
These Terms may be available in multiple languages; however, the Turkish version shall be the legally binding version in case of any discrepancies.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Türkiye. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the Istanbul (Caglayan) Courts and Enforcement Offices.
11. Changes to These Terms
We may update these Terms from time to time. If we make significant changes, we will notify users via email or through the platform. When a new version is published, a re-confirmation dialog will request your approval upon your next login; refusal may result in account deactivation. The SHA-256 hash of each accepted version and the acceptance event (IP, user-agent, timestamp) are secured via audit log. Continued use of the Service after any changes constitutes acceptance of the revised Terms.
